This Seller Disclosure Acknowledgment is a general statement of a seller's responsibility to disclose known material defects in a property. It is not a substitute for the seller disclosure forms required by your state. Rufkey provides this acknowledgment to remind sellers of their disclosure obligations; it does not provide state-specific disclosure forms or legal documents.

Compliance with your state's requirements

Real estate seller disclosure laws vary by state. Many states require sellers to complete a specific statutory disclosure form covering known material defects, lead-based paint hazards, environmental conditions, and other matters. You, the seller, are solely responsible for determining which disclosure requirements apply to your transaction and for complying with them. Rufkey does not maintain a library of state-specific disclosure forms and does not provide legal advice about which forms you must use.

Seller's duty to disclose known material defects

As a seller on Rufkey, you have a duty to disclose to prospective buyers any known material defects that affect the value, desirability, or habitability of the property. A material defect is a condition that a reasonable buyer would consider important in deciding whether to purchase the property or in negotiating its price. This duty exists regardless of whether your state imposes a specific disclosure form. Failing to disclose a known material defect can expose you to legal liability after the sale.

Indemnification of Rufkey

You agree to indemnify, defend, and hold harmless Rufkey and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your failure to disclose a known material defect, your failure to comply with your state's seller disclosure requirements, or your use of any incorrect or incomplete disclosure form. This indemnification obligation survives the completion of your transaction.
